Owens-Illinois, Manville, and API asbestos trusts raise their payment percentages

Three asbestos bankruptcy trusts raised their payment percentages in late summer 2026, according to notices each trust posted. A payment percentage is the share of a claim's approved value that a trust actually pays.

In short

  • Owens-Illinois Asbestos Personal Injury Trust: 50% to 65%, effective August 19, 2026.
  • Manville Trust: 5.1% to 5.6%, approved "effective immediately" in a notice posted September 3, 2026.
  • API Inc. Asbestos Settlement Trust: 22% to 44%, for claims approved on or after September 1, 2026.
  • Each trust says claims already paid at the lower rate are eligible for a supplemental payment under its own rules.

What changed

Owens-Illinois. The Trustees of the Owens-Illinois Asbestos Personal Injury Trust approved an increase in the payment percentage from 50% to 65%, effective August 19, 2026, with the consent of the trust's advisory committee and its representative for future claimants. The notice says the Trustees weighed estimates of present and future claims, the trust's assets, and expected expenses, as the trust's distribution procedures require. It adds that claimants who were paid at a lower percentage "shall receive a supplemental payment."

Manville. Claims Resolution Management Corporation, which processes claims for the Manville Trust, posted on September 3, 2026 that the Trustees approved, "effective immediately," an increase from 5.1% to 5.6%. Its online system began setting all new offers at 5.6% on September 2 and re-issued outstanding offers at that rate. The administrator said it had identified claims eligible for a retroactive supplemental payment and planned to issue those payments in mid-October.

API. The Trustee of the API Inc. Asbestos Settlement Trust, created in API's Minnesota bankruptcy, set the trust's Payment Sum Percentage at 44%, up from the 22% set in July 2023, effective for all claims approved on or after September 1, 2026, whether or not they were filed before that date. A second notice the same day authorized a supplemental distribution to bring previously approved claims up to the 44% level.

Trust Before After When
Owens-Illinois Asbestos Personal Injury Trust 50% 65% Effective August 19, 2026
Manville Trust 5.1% 5.6% Notice posted September 3, 2026
API Inc. Asbestos Settlement Trust 22% 44% Claims approved on or after September 1, 2026

What a payment percentage means

A trust first decides what a claim is worth under its own schedule, then pays a percentage of that value. A higher percentage means a larger share is paid. The percentage alone does not tell anyone what a particular claim will receive, and each trust's eligibility rules, values, and timing differ. Other trusts also changed their percentages this year, some downward; this post covers only these three notices.

What families can do

If you have a claim pending with one of these trusts, or one was paid in the past, the lawyer or claims representative who filed it can say whether a supplemental payment applies. Our asbestos trust funds guide explains how trust claims work in general.
