Documented asbestos exposure in Massachusetts

We list only sites where asbestos is documented by a government agency or published research. Many other workplaces in Massachusetts likely used asbestos-containing insulation and equipment, but we do not name a site unless we can point to a record.

A vermiculite plant in Easthampton (Hampshire County)

Vermiculite mined at Libby, Montana, was contaminated with asbestos. The federal Agency for Toxic Substances and Disease Registry (ATSDR) studied 28 sites around the country that processed it. The Zonolite Company, later W.R. Grace, plant in Easthampton processed Libby vermiculite from about 1963 to 1984 with an estimated 20 to 23 employees at a time, and invoices show roughly 183,000 tons received. It is the only New England site in ATSDR's study.

Massachusetts filing deadlines

Claim Deadline Statute
Personal injury 3 years M.G.L. c. 260, 2A
Wrongful death 3 years M.G.L. c. 229, 2

Massachusetts allows three years for tort claims, including personal injury (M.G.L. c. 260, section 2A). Wrongful death claims must be brought within three years of the death, or within three years of when the executor or administrator knew, or reasonably should have known, the facts behind the claim (c. 229, section 2).

Also note: Wrongful death: 3 years from death, or from when the executor or administrator knew or should have known the basis for the claim.

Deadlines and discovery rules change and depend on the facts. Confirm them with a lawyer licensed in Massachusetts. Compare other states in our national table.

Common questions

Our family only recently learned asbestos caused the death. Is it too late?

Not necessarily in Massachusetts, where the three years can run from when the executor or administrator knew or should have known the basis for the claim. Ask a Massachusetts lawyer to review the dates.
