Documented asbestos exposure in Ohio

We list only sites where asbestos is documented by a government agency or published research. Many other workplaces in Ohio likely used asbestos-containing insulation and equipment, but we do not name a site unless we can point to a record.

A vermiculite plant in Marysville (Union County)

Vermiculite mined at Libby, Montana, was contaminated with asbestos. The federal Agency for Toxic Substances and Disease Registry (ATSDR) studied 28 sites around the country that processed it. The O.M. Scott & Sons plant in Marysville received roughly 430,000 tons from 1963 to 1980, according to invoices, and ATSDR notes it ran eight exfoliation furnaces when most plants had one to three. NIOSH also evaluated the facility, then operated by The Scotts Company, and ATSDR supported a disease progression study of former workers from a vermiculite processing site in Ohio, along with studies of former workers and their household contacts.

Ohio filing deadlines

Claim Deadline Statute
Personal injury 2 years R.C. 2305.10(A), (B)(5)
Wrongful death 2 years R.C. 2125.02

Ohio allows two years for bodily injury (R.C. 2305.10(A)) and two years from the death for wrongful death (R.C. 2125.02). For asbestos, R.C. 2305.10(B)(5) says the claim accrues when a doctor informs the person of an exposure-related injury, or when they should have known of it, whichever comes first.

Also note: Asbestos claims accrue when a doctor tells the person of an exposure-related injury, or when they should have known, whichever is first (2305.10(B)(5)).

Common questions

My spouse worked at a plant and brought dust home. Does that count?

It can. ATSDR studied asbestos-related conditions among household contacts of former vermiculite workers, including in Ohio. Tell your doctor, and a lawyer can review whether a claim is possible.
